When you agree to purchase products (“Products”) and/or services for delivery, or other services (“Services”) from Vivi Home Decorative Co., Ltd. (the “Company”) through http://vividecorative.com (the “Website”), the Terms of Purchase shall apply as follows.
1. Description and price of products
1.1 The information contained on the Website is provided by the Company only for the purpose of providing information and as a means of ordering products online only, unless other rights are specified on that webpage.
1.2 The images shown on the Website are for illustrative purposes only. You must read the description of the product to receive accurate and complete information and product details. The color of the product displayed on the Website may differ from the actual color of the product due to many factors, such as the settings of your computer screen.
1.3 Unless otherwise specified, the price of products displayed on the Website is the price specified in Baht per product, and is inclusive of related taxes. However, the listed product price does not include other service fees that will be included in your purchase price.
1.4 The Company reserves the right to change product prices, product descriptions, service descriptions, and any other special offers, at any time and at the sole discretion of the company.
1.5 The Company may remove certain products and/or services from the Website, temporarily or permanently, without notifying you before proceeding.
1.6 The sale of a product shall depend on whether the Company has the product in stock or not. The company will contact you in the case that the products you ordered are out of stock.

3.1 All shipping services are provided by third party carriers.
3.2 You must notify the company of shipping restrictions or obstacles to accessing your location when you make a purchase, and you must ensure that you have received permission from your building or residence to deliver the product(s), before the delivery date. In the event that the Company is unable to deliver the product(s) on the specified date and time due to obstacles to accessing your location, you shall be responsible for the shipping fee of the redelivery. In such cases, the Company has no obligation to deliver the product(s) before you pay the redelivery fee to the Company.
3.3 You have the duty to inspect condition of the product(s), the packaging, and the number of products delivered, at the time of delivery, and you must sign record of delivery to confirm the conformance, packaging condition, and quality of the product(s).
3.4 In the event that you found issues with the product, or found that it is nonconforming, you must specify such details of the nonconformance of the product, package or quantity in the record of delivery.
3.5 You must allocate time in your schedule to be able to receive the purchased product(s) and service(s), as set in the delivery schedule. In the event that you are unable to receive the product(s) yourself, you must provide a person who is at least 20 years of age, who can accept the products on your behalf. 4.2 You may return the product(s) to the company within 21 days from the date you made the purchase. The returned product must be new, unused and undamaged.

4.2.2 You are responsible for the shipping fee for the return of products. Nevertheless, in the case that the Company pays the shipping fee, such shipping fee will be deducted from the refund amount.

4.3 The Company will only exchange a product if it is damaged, defective, or nonconforming.
4.4 The refund of all payments to the person making the payment shall be made through the payment method used, and has been authorized. The refund payment will be processed within 15 days.
4.5 Refunds will depend on The Company shall refund you when the Company has received and inspected the product which you have returned, and has accepted the product. Nevertheless, the Company may reduce the amount refunded to you based on the depreciation of the product returned.
5. Liability of the Company
5.1 The Company shall not be liable for any loss or damage arising from improper use, incorrect operation, defective installation, or any kind of use test carried out by you or third parties, deterioration from normal use, or intentional damage, carelessness, abnormal use, moving of the product which is incorrect or careless, incorrect maintenance, overuse, unsuitable working materials and spare parts, bad use, improper positioning, or chemical or electrical causes, or failure by you or a third party to comply with the Company’s explanations in the user manual and/or the Terms of Purchase.
5.2 The Company shall not be liable for any damage caused to third parties, whether directly or indirectly, that are caused by repairs or remedial work carried out without prior written approval of the Company, and you must compensate the Company for any losses arising from these claims.
6. Force majeure
The company is not liable for non-performance of duties, or errors, interruptions or delays in the fulfillment of its obligations under these Terms of Purchase (or any part of the Terms of Purchase), or any inaccuracies, inauthenticity, or unsuitability of the Website content and/or services, which is caused partially or wholly by circumstances or errors which are beyond the Company’s reasonable control, including fire, flooding, earthquakes, storms, natural disasters, war, rioting, terrorism, or malicious acts against or the destruction of the Company’s buildings, equipment or belongings.
7. Governing law
These Terms of Purchase shall be governed by and construed in accordance with the laws of Thailand. In the event of a dispute under these Terms of Purchase, you hereby submit to the exclusive jurisdiction of the Courts of Thailand.
